Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Qypsy (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Qypsy.

1. Eligibility & Changes

You must be capable of forming a binding contract and comply with applicable laws. We may modify the Services or these Terms at any time. We will update the “Last updated” date and may provide additional notice where appropriate. Continued use indicates acceptance.

2. Accounts

Qypsy may be used without an account. If accounts are introduced, you are responsible for your login credentials and all activity under your account. Notify us of any unauthorized use.

3. Acceptable Use

• Do not violate laws, third-party rights, school/employer policies, or exam rules.
• No scraping, bulk extraction, or automated access beyond what is permitted by our robots.txt and normal browser usage.
• Do not reverse engineer, interfere with, or disrupt the Services.
• No uploading or sharing of infringing, harmful, or illegal content.
• No attempts to access data not intended for you or to bypass security controls.
• Use of Qypsy to cheat on assessments or violate academic integrity policies is prohibited.

4. Content & Intellectual Property

The Services, including questions, explanations, text, graphics, logos, and software, are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works.

We grant you a limited, non-exclusive, non-transferable license to access and use Qypsy for personal, non-commercial study. Any commercial use requires our prior written consent.

5. User Content & Feedback

If you submit content (e.g., corrections, feedback, messages), you grant Qypsy a worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, and display such content for operating and improving the Services. Do not submit content you do not have rights to share.

6. Third-Party Services

Qypsy may link to or integrate third-party services (e.g., analytics, advertising, email delivery). We are not responsible for third-party content or practices. Your use of third-party services is at your own risk.

7. DMCA & Rights

We respect intellectual property rights. If you believe content infringes your rights, submit a request via the Contact page (choose “DMCA / Content Removal”) with sufficient detail to identify the material and your rights. We may remove or disable access to alleged infringing content and, where appropriate, terminate repeat infringers.

8. Disclaimers

QYPSY IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT QUESTIONS, ANSWERS, OR EXPLANATIONS ARE ERROR-FREE OR THAT THE SERVICES WILL BE UNINTERRUPTED OR SECURE. QYPSY IS FOR EDUCATIONAL PRACTICE ONLY AND DOES NOT GUARANTEE ANY SCORE OR CERTIFICATION OUTCOME. QYPSY DOES NOT PROVIDE PROFESSIONAL, LEGAL, OR MEDICAL ADVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QYPSY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD $100.

10. Indemnification

You will indemnify and hold harmless Qypsy and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity) will survive.

12. Governing Law; Dispute Resolution

These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to arbitration.

13. Miscellaneous

• These Terms constitute the entire agreement between you and Qypsy regarding the Services.
• If any provision is held invalid, the remaining provisions remain in full force and effect.
• Our failure to enforce a provision is not a waiver of the right to do so later.
• You may not assign these Terms without our consent; we may assign them as part of a merger, sale, or reorganization.
